1. Overview

These Terms of Use ("Terms") govern your access to and use of the GainsLog mobile application, web experiences, and GainsLog Premium subscription (collectively, the "Service"). By creating an account, accessing the Service, or activating GainsLog Premium, you agree to be bound by these Terms.

If you accept these Terms on behalf of another person or an organization, you confirm that you have the authority to bind them and that all references to "you" apply to that entity. If you do not agree to these Terms, you may not use the Service.

GainsLog is currently offered as a free product with optional Premium features. Certain advanced functionality is unlocked only through a GainsLog Premium subscription, and we aim to keep the core Service free for as long as possible.

2. Eligibility and Account

You must be at least 16 years old to create a GainsLog account. If you are under 18, you represent that you have permission from a parent or legal guardian to use the Service and to accept these Terms on your behalf.

3. Subscriptions and Billing

GainsLog Premium is available as a paid subscription. Current plan details and pricing are displayed at the time of purchase. When you subscribe through the Apple App Store or Google Play Store, those platforms process your payment and manage renewals according to their respective terms and policies.

• Subscriptions renew automatically at the end of each billing period unless canceled at least 24 hours before renewal via your app store account settings.
• We presently offer a monthly plan and may introduce additional durations—such as three-month or annual options—in the future. Any new plan will be clearly communicated before it becomes available.
• A 30-day free trial may be offered for new Premium subscribers. Trials convert to a paid subscription at the end of the period unless you cancel beforehand in your app store settings.

We receive only the transaction confirmation necessary to activate Premium features. We do not receive your full payment details from Apple or Google. If we change pricing, we will notify you in the app or by email, and continued use after the change takes effect constitutes acceptance of the new pricing.

4. Withdrawal and Refunds (EU Digital Content)

By purchasing GainsLog Premium, you consent to immediate access to the digital content and acknowledge that you waive your statutory right of withdrawal once Premium features become available to you. Refund requests for App Store or Google Play purchases must be directed to those platforms, as GainsLog cannot issue refunds for in-app purchases processed by third-party stores.

5. Use of the Service

The Service is intended for personal fitness planning, habit tracking, and educational purposes. GainsLog does not provide medical advice. Always consult a qualified healthcare professional before starting any exercise program or making significant lifestyle changes.

While GainsLog may surface data-driven insights, training decisions remain yours. GainsLog is not responsible for injuries, fatigue, or other outcomes that may result from following information provided by the Service.

6. Prohibited Conduct

You agree not to:

• reverse engineer, decompile, or attempt to derive source code from the app or backend systems;
• upload malware, interfere with the Service, or attempt to circumvent security controls;
• share, resell, transfer, or rent your account or Premium access to others; or
• use the Service in a way that violates applicable law or infringes third-party rights.

7. Intellectual Property

All workouts, programs, text, graphics, trademarks, and other content within the Service are owned by GainsLog or its licensors and are protected by intellectual property laws. GainsLog grants you a limited, non-exclusive, non-transferable, and revocable license to use the Service solely for your personal, non-commercial fitness goals.

8. Disclaimers

The Service is provided on an "as is" and "as available" basis. GainsLog makes no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee specific strength, performance, or health outcomes. Your results depend on a variety of factors outside our control, including training choices, nutrition, sleep, and overall health.

9. Limitation of Liability

To the maximum extent permitted by law, GainsLog is not liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits or data, arising from or related to your use of the Service.

In all cases, GainsLog' total aggregate liability for claims relating to the Service will not exceed the total amount you paid for GainsLog Premium during the twelve (12) months immediately preceding the event giving rise to the claim.

10. Termination

We may suspend or terminate your access to the Service if you violate these Terms, misuse the Service, or engage in unlawful conduct. You may delete your account at any time within the app or by contacting us at ossianhempel@gmail.com.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of Sweden. Any disputes arising out of or relating to the Service will be subject to the exclusive jurisdiction of the competent courts of Sweden, without prejudice to your rights as a consumer under applicable EU law.

We may update these Terms periodically. If a change is material, we will notify you through email, in-app messaging, or by posting an updated version with a new "Last updated" date.
